Terms of Use - Setsy

Effective October 11, 2026

Setsy ("the app") is a concert passport made by Kept Records LLC, an Ohio limited liability company ("Kept Records", "we", "us"). These terms are an agreement between you and Kept Records. By using Setsy you agree to them. If you don't agree, please don't use the app.

Who can use Setsy

You must be at least 13 years old to use Setsy. If you are under 18, you need permission from a parent or guardian, and they agree to these terms on your behalf. You can't use Setsy if we have previously removed you from it, or if the law where you live doesn't allow it.

Guest use and accounts

You can log shows without an account. As a guest, your shows are kept on your device, and they can be lost if you delete the app or lose your phone before creating an account.

To add friends, comment, or send invites, you need an account, created with Sign in with Apple or an email link. You are responsible for what happens on your account and for keeping access to your Apple ID or email secure. Your handle and display name must not impersonate another person, artist, venue, or brand, and we may reclaim a handle that does.

Your content

Your content is what you add to Setsy: shows you log, captions, comments, your handle, display name and profile photo, invites, and private events. You keep ownership of it.

So that Setsy can work, you give Kept Records a worldwide, non-exclusive, royalty-free license to store, copy, display, and format your content for the purpose of running the app. That includes showing it to the people the app shares it with (for example your friends, other people at the same show, or the guests of a private event) and putting it on share cards you choose to create. This license ends when you delete the content or your account, except for copies other people already saved or shared outside the app.

You are responsible for your content. Only post things you have the right to post.

Community rules

Setsy has zero tolerance for objectionable content and abusive users. You may not use Setsy to post or send:

You also may not use Setsy to follow or track another person, to collect other users' information, or to interfere with the app, including by accessing it through automated means or trying to get around its security or privacy controls.

Reports and enforcement

If you see content or behavior that breaks these rules, report it to admin@keptrecords.com. We review reports within 24 hours. We may remove content and suspend or permanently remove any account that breaks these terms, with or without notice. Where the law requires, we may report content to the authorities.

Seeing who was there

Setsy can show you friends and other people who logged the same show. Treat that as a way to share memories, not as permission to contact or find someone who doesn't want that. If you decide to meet someone you know through Setsy, you do so at your own risk, and Kept Records isn't responsible for what happens between users.

Invites and private events

The host of a private event decides who is invited. Don't forward invite links to people the host didn't invite, and don't share the details of a private event outside the guest list. We aren't the organizer of any event in the app and aren't responsible for whether it happens, who attends, or what takes place there.

Share cards

When you save or post a share card to another app, that copy leaves Setsy. We can't delete it for you, and the other app's terms apply to it.

Our content and other people's

The Setsy name, logo, design, and software belong to Kept Records. You may use the app for your own personal, non-commercial use, and you may not copy, modify, resell, or reverse engineer it except where the law allows.

Artist photos are provided by Deezer and belong to their owners. Artist, venue, and event names belong to their owners too. Setsy is not affiliated with, endorsed by, or sponsored by any artist, venue, promoter, or ticket seller shown in the app, and it does not sell tickets.

Show information

Show details in Setsy are entered by users. We don't guarantee that dates, lineups, venues, or times are correct. Check with the artist or venue before relying on them.

Disclaimers

Setsy is provided "as is" and "as available". To the fullest extent the law allows, Kept Records disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the app will be uninterrupted, error free, or that data will never be lost.

Limitation of liability

To the fullest extent the law allows, Kept Records will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or harm caused by other users, arising from your use of Setsy. Our total liability for any claim relating to Setsy is limited to the greater of the amount you paid us in the 12 months before the claim, or $10. Some places don't allow these limits, so they may not all apply to you.

Indemnity

If someone brings a claim against Kept Records because of your content or your breaking these terms, you agree to cover the reasonable costs of that claim, including legal fees, to the extent the law allows.

Ending your use

You can stop using Setsy at any time and can delete your account from Edit profile > Delete account. Deleting your account removes your profile, logged shows, comments, invites, and friend connections from our servers. We may suspend or end your access if you break these terms or if we stop offering the app. The sections on your content license (for copies already shared), disclaimers, limitation of liability, indemnity, and governing law continue after your use ends.

Changes

We may update these terms. When we do, we'll change the effective date above, and for significant changes we'll let you know in the app. If you keep using Setsy after a change, you accept the new terms. If we ever offer paid features, we'll publish the terms for them before charging you.

Governing law

These terms are governed by the laws of the State of Ohio, without regard to its conflict of law rules. Any dispute relating to Setsy will be decided by the state or federal courts located in Ohio, and you and Kept Records agree to their jurisdiction. If any part of these terms can't be enforced, the rest still applies.

If you downloaded Setsy from the Apple App Store, these terms also apply:
